You declare that you accept to be bound by these terms by using this website.
In the event of a conflict between such Terms and these Terms & Conditions of Use, the Terms shall govern.

Any modification to the terms and conditions of this website shall be effective as of the date and time of its publication as a part hereof, and shall be deemed given to the user upon such publication.

You have agreed to the updated Terms if you continue to use the service after any such changes.

The brands whose used and refurbished products are sold on or through www.tangerineluxury.com are not affiliated with Tangerine luxury in any way.

 

Terms and conditions

According to the Information Technology Act of 2000, these “Terms & Conditions of Use” are an electronic record.

The Information Technology Act of 2000’s Section 2(1)(w) defines us as an “intermediary,” and this is what we do.

This Agreement is published in accordance with the requirements of Rule 3 (1) of the Information Technology (Intermediaries guidelines) Rules, 2011, which mandates the publication of the terms for accessing or using the services as well as the rules and regulations, privacy policy, and other related information.

The terms “User,” “Client,” “You” and “Your” refer to the user who accesses this website and agrees to be bound by the terms and conditions of Tangerine Luxury.

In accordance with and subject to applicable Indian law, all terms refer to the offer, acceptance, and consideration of payment necessary to carry out the process of our assistance to the User/Client in the most appropriate manner to satisfy the Client’s specific needs for provision of the Tangerine Luxury’s stated services.

Company Model

Tangerine luxury is your go-to source for previously owned and refurbished goods (apparel and accessories) that go through a rigorous procedure encompassing inspection, verification, and refurbishing to assure successful reuse. The company will plant one tree and maintain it for three years for every 50 goods sold as part of its contribution to environmental protection.

The linear “take-make-waste” approach is replaced by the circular “close-the-loop” model, which calls for each product to be ethically used and to have a responsible usage and end-of-life.

Collection procedures

The seller can notify Tangerine luxury that the items are ready for collection by calling +7065070422 or sending an email to sales@tangerineluxury.com.

We only collect stuff from parents or households of newborns or kids up to the age of 13, and each seller is only allowed to give out 30-40 pieces of merchandise (apparel & accessories) at once.

Collection or sale from or through vendors is not permitted.

The onus is on the seller to make sure the item is accessible for pick-up at the time and on the scheduled day.

Tangerine luxury has the right to impose a reasonable fee for any additional collection trips if our courier is unable to pick up an item because no one is accessible at the designated collection address or if the seller has provided an invalid or incomplete address.

By making an item available for pickup, the seller attests that: The item in question is legally hers; and the seller is not the product’s reseller.

Without consent from anybody else, the seller has the entire right to sell the object for renovation (or that you have obtained any necessary permissions).The item is a true representative of the brand it claims to represent and is not a counterfeit version of another item with a different trademark.

All items sent to Tangerine luxury for inspection, authentication, and verification must be examined by the seller.

Apart from the products that are intended to be supplied for collection, if we discover any valuables in or among the aforementioned items, we will make every attempt to restore them to the seller.

However, we cannot be held responsible for the loss of any such items that are submitted to us.

The vendor must make all paperwork, receipts, warranty cards, original packaging, dust bags, and any extras for the aforementioned items readily available for pickup.

Please be aware that by asking for the removal of an item from Tangerine luxury, the seller might be held responsible for any assumed delivery costs.

The vendor will receive a receipt for the things that Tangerine luxury has collected.

Process of post - authenticfication / cost analysis

If our authentication team does not approve your product, we will return your product(s) to you in the same condition that we received them in exchange for a rejection charge of Rs.3000 from you.

This is why we suggest you make sure the products you provide us are genuine, in good shape (with no signs of functional wear and tear), and the estimated price is more or less acceptable to you.

Tangerine luxury will rigorously examine acceptance using a variety of inspection, verification, and authentication procedures used on the collected objects.

Tangerine luxury has the right to reject a collected item in its sole discretion, subject to the results of the inspection, verification, and authentication processes.

Tangerine luxury will choose the price to be applied to any accepted products and the sum to which Tangerine luxury shall be entitled upon the sale of such products upon acceptance of any collected items.

Our runner will contact the Seller with an agreement once the Seller has agreed on the cost of the product(s), and at that point, the agreement must be properly completed, signed, and returned to the runner.

The product(s) would be returned to the seller at a nominal cost of Rs.400 or the seller might have it picked up from our office at no cost if the worth or costing of any goods, or all products, is not acceptable to the seller.

Valuation procedures

The objects would be assessed in the following categories: WITH TAGS, NEW WITHOUT TAGS,PRISTINE, GOOD CONDITION, USED FAIRLY WELL.The condition, value, and potential for refurbishment of the item or items will next be examined, verified, and authenticated by our in-house personnel. The product’s marketability and approximate market value will then be determined.

We will email the seller the price at which the seller’s products can be sold once the product(s) have passed the INSPECTION/AUTHENTICATION/VERIFICATION PROCESS.

Listing preloved

Please take note that after the contract is signed, the product(s) will be posted on the website within two to three weeks.

Additionally, we would advertise the sellers’ goods on social media.

For a period of four months, the product(s) would be listed on our website.

The product(s) in question would be removed from the internet listing and given back to the seller if no customer placed an order for any of the specific product(s) so continually listed on the website for a period of 4 months.

As an alternative, the Seller may ask that the product(s) be kept on the market for a further two months, with a discounted price determined with the Seller’s consent.

Tangerine luxury will charge the seller 20% of the price that was provided to the seller as Tangerine luxury’s handling fee if, for any reason, the seller decides not to wish to sell its product(s) or if the seller demands the return of its products before the agreement is established.

The individual who delivers the collected items to Tangerine luxury shall not object in any way to the displayed items/products on Tangerine luxury’s website.

Restoration process

Following the execution of the contract, we will begin the cleaning procedure, which includes product spa and product photography (s).

Tangerine luxury won’t significantly affect or change the item’s character or design during the refurbishing process.

However, refurbishing would also involve performing any necessary cleaning, tailoring, or textile work to increase the pre-owned item’s worth and longevity while improving its condition to a high degree of use.

Tangerine luxury disclaims any liability for any harm or alteration brought about by the application of refurbishment procedures to the things it has gathered.

 

Sales of refurbished and preloved items

At the time of sale, the product’s packaging would just say “Tangerine luxury” to denote that Tangerine luxury had refurbished the pre-owned item.

  1. In the case that the seller’s merchandise is sold, the Tangerine luxury team will notify the seller within 15 days.
  2. Please be aware that any tax or fee that is imposed, including GST, commission, or any additional value-added services, will be paid by the seller.
  3. Please take note that in addition to any taxes, levy fees, or other amounts that become due as a result of the sale of the aforementioned product, the price of the refurbished product will include Tangerine luxury entitlement in the selling proceeds of the device.
    When a product is sold, our team notifies the seller.
  4. Within 30 days of receiving the sale price from the buyer, the seller will be compensated for the product(s) sold by account transfer or check. The sum that would be remitted to the seller would be subject to a deduction for any sums that Tangerine luxury would otherwise be entitled to from the sale of the purchased item(s).
  5. Within three days of purchase, customers are permitted to return the items they have purchased. Tangerine luxury will issue credit notes with a 12-month validity term in place of refunds for any returned goods. The option to redeem credit notes may only be used once.

Indemnity clause

  1. While Tangerine luxury takes all necessary precautions to ensure that the products are free of any potential infections, it is made clear that the seller will be responsible for holding Tangerine luxury harmless in the event that any third party claims arise out of the use of the products and lead to any physical condition, including bodily infections.
  2. Tangerine luxury will not be responsible for any claims made by a third party, later buyer, or user arising out of the usage of the refurbished goods, even if it is sold or given away by the buyer to a third party.
  3. The seller is responsible for holding Tangerine luxury harmless from any losses or claims stemming from misrepresentation or concealment with regard to the things the seller has sent to Tangerine luxury.
  4. While Tangerine luxury makes every effort to ensure that the products/items are authentic from the companies/manufacturers/brands the seller claims such products/items to be, in the event of any claims/actions by such companies/manufacturers/brands on a basis pertaining to the genuineness of such product/item or concerning issues involving the products/items’ intellectual property rights, the seller would be responsible for protecting Tangerine luxury against all such actions/c
  5. Any product damage caused by disasters, divine acts, or other unforeseen events that may be beyond Tangerine luxury’s control shall not subject Tangerine luxury to liability.

Disclaimer

You agree to use your best and most cautious judgment before engaging in any transactions through the website, and you realize that you are accessing the website’s services and transacting at your own risk. Additionally, you realize and agree that you will only use the website to order things for personal, not commercial, use. We clearly disclaim all duty and liability in this regard and agree that we shall not be held liable or responsible for any actions or failure to act on the part of sellers, nor for any breach of terms, representations, or warranties made by sellers or product makers. Any disagreements or disputes between you and the product’s vendors or makers are not our responsibility to mediate or resolve.

In addition, we expressly disclaim any express or implied warranties or representations regarding the quality, suitability, accuracy, reliability, completeness, timeliness, performance, safety, merchantability, fitness for a particular purpose, or legality of the products listed, displayed, or transacted, or the content (including product or pricing information and/or specifications) on the website. Although we have made steps to ensure the product’s authenticity and prevent content inaccuracies, this website, its material, information (including the price of products), software, products, services, and related visuals are supplied “as is” and without any warranties of any kind.

Thus, you expressly understand and accept that use of the website and the service is totally at your own risk and that the website and the service are given on a “as is” or “as available” basis, without any guarantees of any kind.

Rules and jurisdiction for goverment

The courts in Faridabad shall have exclusive jurisdiction over any matter or dispute relating to or arising out of this Agreement, subject to the requirements of Clause.14 (Dispute Resolution) below. This Agreement shall be governed by the laws of India.

Controversy resolution

Grievance Officer: In accordance with Rule.3 (11), Information Technology (Intermediaries guidelines) Rules, 2011, Tangerine luxury has designated and made the name of the grievance officer publicly available on www.tangerineluxury.com. Tangerine luxury will take the following actions if a customer complains about a breach of sensitive or personal information:

The Grievance Officer must inform the party who filed the complaint that it has been received within 36 hours of receiving it.

Additionally, the Grievance Officer will see to it that the data or information against which the complaint is received is withdrawn from the website or access to that data is denied within 36 hours of receiving the complaint.

The Grievance Officer will also act on the complaint and find a solution within one month of receiving it.

Arbitration informally.

– Good faith talks between the buyer and the Tangerine luxury Coordinator, as described on www.tangerineluxury.com, shall be used to settle any issues between the parties relating to the Sale of Products or the conditions as mentioned above. Any party may begin arbitration in accordance with the Arbitration provision of this Agreement if the issue is not addressed within sixty (60) days of the request for negotiation by giving writing notice to the other party.

Arbitration. If:

When a dispute is not resolved in accordance with the provisions of the Informal Dispute Resolution section of this Agreement and a party (the “Pursuing Party”) is still willing to pursue it, the pursuing party may request that any dispute, difference, or question arising from or related to the terms and conditions mentioned herein, the commission of any violation of any provision of this Agreement, or in any other way connected with this Agreement or the business conducted on www.tangerineluxury.com be resolved. The judgment or reward made in this manner shall be conclusive.
